One thing I forgot to mention is that I was very much looking forward to reading the IER from BDO to see how much weight (if any) they placed on the data confirmation test.
As it turns out and the way I read the valuations, it seems like it was just terrible negotiation skills to have tied any re-negotiation to the Data Confirmation Test. It doesn't seem to have played a particular part in the assessment as while the reports acknowledge the results, the valuations were done on different metrics.
At a minimum, we should be sitting at the preferred value without any handcuffs to the data confirmation test, which was an unnecessary risk. If anything, positive results should have been tied to the upper range of the valuation.
