Agreed with your points above. There's no mention of any authority on ACCC issues at all. In my reading the article is expanding on the (completely reasonable) views from COG.
While it doesn't change the validity of the underlying points raised, I don't think that the opposing party to a competitive takeover bid can be relied upon as the best source of objective wisdom on a topic like this.
