I think it would be difficult to argue a breach of contract for taking work away from SSM in situations where the sub-contractor already has contracts with NBN directly to undertake similar work (and for the other major telcos) and IP can be a murky area to litigate.
What I was more focused on was that the sub-contractor staff physically on the ground installing and designing cabinets, laying cables etc. would be taking away more of the learnings of how to provide better service offerings to NBN (in addition to the work they are doing with other major telcos directly) than a project manager sitting in head office and doing the cook's tour of projects from time to time.
My 2c on the matter anyways. As I've said before I think it is a genuine risk but it is difficult to quantify.
