Nope ability to pay out I assume they indicating it was simply due to the max franking credits available to provide a fully franked dividend.
Special Div estimated amount - 125,883,215 shares issued x 1.2c = $1,510,598. I think settlement would have been higher than this given they would have spent $1m on memory alone on legal fees across last 2 or so years.
Still good news a special dividend and settlement of maybe $2-3m. Although still a lot less than the $10m or so that was previously fully written off as bad debt (plus incurring $1-1.5m in legal costs).
We will know more when we see the year end accounts obviously.
