If you have a capital loss you can offset a future capital gain. If you you have no future capital gains as large as the loss you lose out forever. Any money received from the CA will need to be declared to ATO and taxed accordingly. Nobody will receive from CA adequate compensation to put them in the financial position they were in. Anyone who says differently is wrong.
