If you feel that strongly about their under performance, (and I’m not saying it’s not justified), have you considered talking to a class action litigator? There are those that work on a ‘no win, no fee’ basis. Perhaps they’ll give it a look to see if it’s worthwhile pursuing. If they don’t, then it’s not- simple as that. It’d be folly to use your own or shareholder funds to chase a low percentage legal case.
My feeling is it will be fruitless, the decision making and corporate structure/governance very poor/flawed from the outset, yet not reaching a threshold necessary to get an insurer to pay out, or get a decision in court. But the people best placed to give an opinion are obviously those litigators.
