How can they possible make this announcement based on financial data when there has been no financial data issued by the company since last year's AR?  Even that should probably be restated.

How do FC Capital make the decision to help restructure?  Oh that's right!  They have financial information which has not been released to the market.

It appears to me that they are simply buying time and extracting the last few cents that they can.  Don't have time now but a quick read of the Corporations Act 2001 might be useful.
