The Asic issue feels more like a technical breach at worst and not a open flouting of the rules. This shouldn't be hugely serious and may not involve much more than a one-off penalty. I suspect the much bigger issue is the competitive environment within the hospitality business. The ground has changed while the management were chasing the utes they leased and there are other fleet-footed operators both small and big in every territory. Incidentally, the one liner about North America in the update is hopefully referring to Canada and not a new ventures while there are still fires to put out.
