End of the day if ERG gets the patent and RNU wants to use they will and have to pay a royalty.
As for the royalties there is standard process to come to a valuation and it is usually tiny in context, not even worth mentioning.
Also ERG might not get the patent or RNU might not even use the process so its a moot point.
