I've double checked with a solicitor mate that referred me to the NSW gov lawlink site and you can amend a claim........quote......"a Statement of Claim may be amended once without permission of the Court, within 28 days after the original Statement of Claim was filed, but for any subsequent amendments, a Notice of Motion to Amend must be filed and granted before the amendment can take place". The solicitor tells me that amendments are usually waived through when they are related to and can be substantiated with documentation to the original claim. That would seem to be the case here?
