if MCT win a lot will depend on NME's debt structure and if there are any secured creditors. (i have not taken the opportunity to have a good look at the financial reports).
i would think any claim that MCT has will be as unsecured claim ranking equally with other unsecured creditors unless there is some secured entitlement in the JV agreement which provides for the contractual transfer of any entitlement in the event of any default under the agreement.
