I can't see it.
If Min accumulates 19.9% of TPD (the max without them having to launch a T/O of TPD themselves); then under the SoA that'd convert to 2% of STX.
They can buy 2% of STX on the market without much difficulties or disclosure (they would have to disclose a 19.9% position in TPD).
In fact, they should have already popped up on the TPD register if that's the case. The shorted value of STX would exceed 5% of TPD's market cap.
