    As I understand, under the Law of Tort, the Plaintiff can only recover actual losses from the Defendant in a legal claim - meaning the Court can't put you back into a better financial position than would otherwise be the case.

    It is a possibility that ISX has got back (or expects to get back) a fair chunk of the lost business and therefore may have trouble proving the quantum of losses was being claimed against ASX. There would not be any point fighting on and incurring further legal costs if the losses being claimed were getting more and more difficult to substantiate as the business grows? It will be very interesting if VGW is a customer in the near future.
