Most of these actions usually contain a 'cover-all' order at the conclusion of the pleading along the lines of 'Such further or other orders as the Court sees fit'. If ASIC make good on their case and the declarations sought are made, this gives the Court a fairly wide ambit as to the final Orders. The Federal Court has equitable jurisdiction so it's unlikely to be an issue if an Order is sought addressing performance shares. Otherwise, it leads to the Court largely being rendered nugatory.
