Well the scale back conditions include something that I have never seen in about 15 years of exposure to SPPs. Offer doc says OCC can scale back based on purchases by applicants after the record date. So everyone who loaded up at 50c yesterday, or buys at any price before offer closes, could get scaled back on that basis , as well as scaled back based on their holding at record date which is becoming the norm with SPPs. I don't know how they would structure a scale back based on post record date purchases and it may just be bluff to make sure that as far as possible OCC gets the funds it wants from existing shareholders.
Of course if you can get enough on market then you might not care about SPP anyway. A binary decision perhaps.
