The $9m is not "sorted out". However, I am not sure that BTR formally agreed to a cost agreement of project financing before Glencore went ahead an did it.
Just because someone says "you owe me $9million" doesn't make it so. I can do that too... topcall, you owe me $9million, pay me now. Are you going to?
Glencore need to explain the reason for the overruns and costs and substantiate them on the delivering best value for shareholders basis. If they haven't acted in this nature and contrary to results from the project, then quite frankly it's a legal matter.
