You raise a good question: like you I thought L&M was no longer operating, and I have not heard of Geoff Loudon. Perhaps he bought L&M as shell for the royalties/payout. I agree that actually getting costs can be a challenge if the losing party is broke; but I also think if Geoff Loudon was skint he wouldnt have funded 3 rounds of litigation. He may have had a third party litigation funder involved, but those funds usually only take on fairly sure bets, and this case seemed anything but. Also they would probably have had to put up security for costs. All speculation mind you. I might ask Bathurst.
