There's really not much they can do because Capocchi's contract has a 9-month notice period. That was another huge mistake for which the board must be accountable.
They could terminate him immediately, but they'll still have to pay him out the notice period.
The only way around it is for MC to resign and forego his entitlements. That would be the right thing to do given he's already become obscenely wealthy at shareholders' expense. Sadly, he could probably buy the company himself if he desired...
