Once payment is made the case can be relisted to set a hearing date subject to any further procedural steps (I don't think there are many if any). If the delay is protracted the defendant could bring a motion to strike out but this is unlikely to happen any time soon. In my view there are 2 possibilities. First the delay is deliberate as a way of making sure the ASIC case (which has a hearing in the new year) goes first as this clearly suits the company (the most likely in my view). Second (but less likely) is that to company is considering not taking the risk with the litigation in which case they will try and resolve it on acceptable terms./
