Primacy of EU law over the Member States
The primacy of EU law applies to all national acts, whether they were adopted before or after the EU act in question.
If EU law takes precedence over conflicting national law, the national provisions are not automatically annulled or set aside.
However, national authorities and courts must refuse to apply these provisions as long as the overriding EU standards are in force.
The principle of primacy is intended to ensure that people are equally protected by EU law throughout EU territory.
It should be noted that the primacy of EU law only applies where Member States have ceded their sovereignty to the EU - areas such as the internal market, ENVIROMENT transport, etc.However, it does not apply to areas such as education, culture or tourism.
