Here's a great article from August 2017.
It includes quotes from an interview with Dr Piyabutr Saengkanokkul, who is a law professor from Thammasat Universit and was a key figure in the Future Forward Party.
He says "I've analysed this case and Thailand has almost no chance of winning. Thailand will definitely have to pay compensation because they breached TAFTA. It all comes down to our ability to negotiate reduced compensation. I've heard that the government is looking to negotiate with Akara to resolve the issue.... If we end up going to arbitration, the chances of us losing and having to pay compensation of up to 30 billion Thai Baht is very high, just like what happened in the case of the 'expressway idiot fee'." He says it will all come down to the PM's use of the section 44 order "...because Thailand decided to use an absolute power to close the mine, protecting it from any appeal process through the Thai court system."
