His offer might be chained to under 70c, but I don't think he keeps the SP chained to under 70c. His offer sets a base... but not an upper limit. If market or company sentiment improves holders can sell or buy for any price they want above his offer. At this stage he has nowhere near the required numbers to push this through or force anyone to sell their shares for his offer price... and the higher the SP goes the harder and harder it will be for him to achieve it. So there is no theoretical upside to the SP apart from market value.
