The question really should be asked - why is BPL not willing and able to either abide by the agreement or fund its share of the JV? Even if that is 5% ($50,000 per million that COB invests) it keeps their equity in the project, which surely would be better than a minimum royalty which is where they appear to be at if they do not pay their bills.
