I'm glad someone is at least calling the issue to task.
The notice mentions "creep". There are ASX rules regarding "creep provisions" / how many shares can be acquired within certain periods and in the context of consideration alongside other interrelated rules.
It appears to be that Simto Resources, which is not Mark Caruso to my understanding, has a genuine concern here and is certainly justified in asking the matter be considered in the appropriate forum of the Takeovers Panel.
The takeover panel will review and consider. All we can do is wait now.
