I guess the counter argument is that they bought up with consideration of further upside if the price could be pushed higher. However working against that is the fact that the buyer (TPG) knows they will be stuck with their holdings if they vote against so there's no real incentive to push the price higher. Net result is it still seems like a lame move for a hedge fund.
