I would be a bit suprised if ERJ get the rights for the US from Opcon. I honestly dont know too much about the ERJ organisation and their potential, but doing business on this level in the US should be quite demanding. I'm thinking about both the number of sites and all the legal issues you might end up with running implementing and running sites. Suing is after all their second largest sport after baseball. This will require a lot of management attention. An expansion in the US will also require a huge amount of capital.
Given the expansion plans and potential ERJ has for Australia it seems like they have pretty much to do anyway.
The best solution IMO would be that ERJ will become be partner/shareholder in the company that will recieve the Powerbox rights in the US a similar way Opcon is a shareholder in ERJ. This would utilize the ERJ experience and drive, but still keep ERJ focus on Australia and the other Asian and sub-Saharan countries ERJ has recieved the rights for.
