Not sure the judge has that kind of authority. Usually they have to stick to judging the case based on the arguments made by the parties. Of course the judge could suggest that the parties take some time to consider their positions before he hands down his judgement. I doubt that the judge would delve too deep into what Pacific Road's underwriting/funding arrangement would do to existing shareholders and even if he did, he would come to the conclusion that it is subject to shareholder approval and that Pacific Road couldn't vote.
