Correct me if I'm wrong but wasn't the XTV issue that the company made the ann and thus overstepped. This (BRN) is a case of the media picking up something and will therefore be an NDA issue if any. I have signed a few NDA's in my time and have never heard of any actions arising from breaches of them (although I'm sure there have been). Worst result will be a peeved potential customer, not great, but not fatal?
