The Federal Court has thrown out a case brought against James Packer’s Crown and pokies maker Aristocrat by a former gambling addict who claimed Dolphin Treasure machines mislead players.
Justice Debbie Mortimer told a standing-room-only courtroom that Shonica Guy’s allegations the display on the machine misrepresented the chances of winning were not made out.
She also dismissed allegations of unconscionable conduct against both Crown and Aristocrat.
An information statement on the machine did wrongly convey the impression that players would receive about 87 per cent of their stake back in a session, Justice Mortimer said.
However, she said this was only a “fleeting” impression that would be dispelled as soon as the player began gambling and discovered the randomness of the game.
