This happens a bit when there is a discrepancy on the scale of the announcement between two parties. CEMEX has a $6bn market cap so an announcement of this nature wouldn't be considered market sensitive, plus US reporting obligations might be different.
However, for CXL with an $800m cap this announcement on their core business, into a new market, would be considered market sensitive.
Cemex probably just got on with issuing the press release to get the message out there without proper consideration for ASX regulatory obligations. But it's certainly not an ideal way to start a relationship.
