I agree that there has been some understanding for DB to give up the case. If you look at the verdict, clearly both parties have strongly highlighted the words – the decision to be made according to the “Law”. This could be the key that they have agreed and to hold as the reason to approve that they are to follow the court order and they didn’t have an option.

Moreover the finding of “Bias” when ScoMo only said 1 time before he was sworn in and that was enough. They didn’t even consider if he was validly appointed. With Albo & King also publicly going against the project before, the finding of “Bias” would be extremely difficult to overcome..
