I think MIN would argue that it is not detrimental to the commercial outcome. If it was, why would they undertake the changes?
In any event, MIN, as the dominant party in the JV, would hold sway on these decisions.
I think the JVOA would be quite clear in that case, despite the rights embedded in the JV for two-party agreement.
