They have probably already paid Mercuria the $21mil in June due to the collapse of the inventory value during May.
Interesting that they're raising US$25mil with the convertible note issue but only $20mil ends up as a liability - so that means they're issuing them at a 25% premium to the face value or repayment/exercise price.
