I’ve reviewed every one of the judgments in this sordid affair and only the NSWCA judgment mentions the VWAP calc, and at a glance, it doesn’t clarify the point at hand.
My GUESS is that the VWAP calc will be immediately pre issue. If that’s correct they would get about 1.5m shares.
