I agree @glossy. I remember a while back to some earlier comments by holders here about us using AZS drillers. Whether or not therein lies a line of communication left open, or maybe even deliberately created. Who knows really?
Look at LTR for example. There were closed door discussions between ALB and LTR at least many months prior to the first ‘announced’ offer, where LTR revealed ALB had already made tentative non-binding offers previously which they rejected but chose to not disclose given they were not in the interests of shareholders. The ASX obviously agreed and probably were kept informed.
So behind doors discussions can be done and if crucially important for the well being of the company and shareholders, it can be the case that there need not be any reason to comply with disclosure obligations due to the exemptions.
