My understanding is that they have patented the process to make vardenafil into a solution suitable for nasal spray. The 3yr exclusivity period the FDA grants is something they give to all drugs where the delivery system is changed. The patents will protect the company from people copying them and making generics of it.
Patent lawyers have apparently been involved and the company is adamant that they have this correct.
