From an announcement compliance perspective given that the CR has been announced so soon after the trial info one can argue that it was a reasonable expectation for investors to have been informed contemporaneously of the news and CR. Those who bought in at higher prices yesterday will be at a financial disadvantage as a result. It’s all a reasonableness test. Disappointing indeed as to timing.
