Company did not have an explicit escrow period / clause - agreed that could have been better and some fault lies with them there.
Company have today announced (in what looks to be a legally considered and written announcement) that despite the absence of an escrow period and in their opinion the Con Note holder has not acted within the broader terms of the Note Deed, I'm not too sure where and how the company can be seen as contributing to that / those suggested breaches of the Deed.
Anyway on a positive, the Note Holder has no shares left, and the balance of the debt is proposing to be paid out.
