Seems like they'd have to be close. They raised $1M last Q and may have cleaned up their approximately quarter million dollars worth of current liabilities (mostly trade payables), which means that, while everyone may have to take a big haircut on salaries, they might legally be in the clear.
This isn't an endorsement. I think think this company is garbage, but there are ways they might not be technically insolvent.
