You can't argue in one sentence that they would be wiped out with the current capital levels & then in another claim they have surplus to requirements.
Just because there is a statutory minimum capital level it doesn't mean they should reduce capital to that level.
If the GFC told us anything it's that regulators get things like capital requirements very wrong.
