You have rose coloured glasses. The other way to look at it is that the open TAFTA case has not hurt their trade relations at all. They have carried on as normal, in fact they have improved. So why would it hurt them in the future. Thais have called KCNs bluff and won. KCN was scared (rightly so) that the Thais would not pay up and that the Australian government would not help one bit to enforce it so we did not call for the judgement.
The thais are now looking for cheap way to get rid of this pesky little case, but they are in no hurry, because there are no real consequences. Just the annoyance of having an open case waved in their face.
