To recover funds despite state immunity, several mechanisms can be considered. One approach involves targeting International Receivables—payments due to the state from foreign entities, such as revenues from oil and gas exports, commodity contracts, or infrastructure projects. Given that Congo’s exports are valued between six to eight billion dollars, intercepting these international receivables could be a viable strategy for enforcing payment. However, it’s important to note that the effectiveness of this approach depends on the specific legal frameworks and the willingness of foreign jurisdictions to permit such enforcement actions.
