In my view, EQX could secure litigation funding for the case almost instantly. I encourage you to look at precedents such as Prairie (GreenX), Indiana Resources (IDA), or Montero (MON.CN). Pursuing a new project would be not only highly risky but also highly dilutive for those counting on an ICSID tribunal to award hundreds of millions in damages.We are months (not years) away from the award. While enforcing the award will be challenging, it is not mission impossible. An ICSID ruling holds the weight of law in 148 ( if I’m not mistaken) countries and Congo-Brazzaville exports over $6 billion annually! Specialized firms "Asset Trackers" track these flows, making asset seizures a viable enforcement mechanism (because it is ICSID). On the one hand, I don’t want to sound overly optimistic, but, on the other hand, valuing the litigation at zero seems like a significant misjudgment. Assigning value to the litigation is a difficult subjective exercice but raising capital now would not only be highly dilutive but IMHO also a serious corporate governance misstep.
