Give up a $Billion (or more) worth of asset that's an easy legal win to claim back, so AVZ dont have to pay tens of millions in fees?

At least try to come up with something that makes sense.

Let's also not forget that AVZ will likely sue and be awarded its legal costs and fees associated with it.
