I've seen the form her lawyers filed (available online) stating they are relying on implied terms. This was in answer to another poster who thought there was a cut 'n dry contract. Irrespective of whether the implied term is 'best efforts' or reasonable efforts'to progress the technology by x date, she has to show what her 'loss' is. She would have to quantify how much such efforts might make. They might result in no gain.
What is notable is that this brilliant little company that provides such amazing diagnostic products for millions of people, and received Govt funding for this, is being run into the ground by dr Finger's selfishness and imaginary loss of profits. She is literally cutting off her face to spite her face and damaging all shareholder's returns.
Her lawyers would have to argue that had she kept her shares and not transferred them, she would've made those imaginary profits.
imo the big added value was already factored-in when the ovarian cancer test came up trumps. Anything extra is pure conjecture.
