The Plaintiff needs to prove that it has a genuine claim. I guess IPL can do that that but it would be up to the judge to determine if NKP could reasonable perform under contract. And on that they couldn’t so it’s hanging on the judge IMO. Defendant normally counter sues.
I am referring to internal resources for example as time or distraction used to defend the lawsuit.
In my opinion I still think it will be a settlement and that IPL is using the situation.
