For the Ecopropp claims, the ATO would only charge shortfall interest if the claims were already paid and need to pay back.
So this isn't just a case of money expected in but not going to be received.
This is a case of LWP having received the money already and have to pay it back.
It effectively owes the ATO $701,851 plus penalties, plus interest.
I think it is also important to release the reasons why the ATO denied the R&D rebate. If the proposed rebate amount for LWP 205 alone was $857,061, then expenditure needs to be around $2.8M (R&D rate is 30%, right?). So the ATO deemed this expenditure not to be R&D. Then what was it, since LWP was at the time a company solely invested in R&D pursuits?
