I think this is a moot point whether ROFR is transferable to MIN, as different parties can and could come to different contracts due to the nature of who they are dealing with; it's not as if a party to the contract is a generic element, it inflects upon the nature of the agreement. And GAM should keep it or give it up.
If PLS we're dealing with MIN writing up a ROFR maybe MIN would want a ROFO, that's where MIN might need to be careful making retroactive demands if that's the case.
I just think MIN & Co. are buying time as they need it for something else....
