I am not sure that is correct. The judge can only hear the application that is before him / her. Judges do not go around making enquiries of their own.
The judge hears the application by the TV2 lawyers. The submissions supporting that are put before the court and are supported by evidence / affidavits and argued on the basis of existing legislation and how previous judgments in similar cases have been interpreted and or applied to the relevant legislation (Corps Act).
I am not sure why an ASX rep would be attending the hearing unless they have been subpoenaed as a witness. It is not TV2 v ASX - it is an application to the Federal Court for relief and ancillary orders.
