To be honest Rooster - I been haven't bothered to search for the minutia of this particular case since the 18 November Case Management Hearing. Boring directions and CM for a TV2U application is not on top of my priority list. Frankly, I have enough of my own work to do and continually rebutting some of the more interesting types around here is unproductive use of time.
Anyway, the second of the orders from 1 December means that ASIC and the ASX can send along their legal representative to the next hearing.
It should be noted that counsel may be there to provide a summary of events / facts as to ASIC action and or ASX action in the current suspension.
However, it is very important to note that ASIC or the ASX are not the plaintiff or the defendant. That was my earlier point. They are attending the next hearing - it would seem. And a judge will never make enquiries of their own outside of the proper case management / hearing process. Costs have been reserved. Usually this will be decided in the final hearing.
